Resolved Question: Should I try and sue for medical malpractice/neglect?
Back in December of '08 my wife started to have complications while she was 6 months pregnant with our 2nd son. She was oozing some fluid and she appeared to be spotting heavy. She was very concerned after about a week or so and we went to the local emergency room. From there they sent her up to the OB unit. They hooked her up to a monitor to monitor the baby's heartbeat. They made her wipe everything clean then pee in a cup. The results of her urine came back normal but they diagnosed her with a bladder infection anyway and gave her a prescription for some Macrobid or something. They never gave her an ultrasound and there was never a doctor that stepped foot into the room. We went home with no improvement, and at the end of the week we went back to the hospital. The same thing went down. They made her wipe everything clean, pee in a cup and again the urine sample came back normal. They told her to continue the macrobid. Again no ultrasound and no doctor. My wife told them that she could not keep missing work for this because they told her that they might be able to give her an ultrasound at the beginning of the week if her condition did not receive better. They told her that she could miss every of the time she needed to because of FMLA. We went home with no improvement in her condition. Monday morning my wife was taken back to the hospital before her ultrasound appointment, and demanded that they do the ultrasound right then. Upon seeing the ultrasound the doctor told my wife that there was no more amniotic fluid and that they could do nothing for her. She was transferred to a hospital an hour and a half away with a very good NICU. Brenten was born approximately 2 weeks later via emergency c-section and it was discovered upon his birth that he had suffered from a rare syndrome known as Amniotic Band Syndrome. Fibrous bands in the amniotic sac had entangled with his limbs and amputated his right foot, his digits on his right hand, and a toe on his left foot. The reason that this was unknown until his birth was because in an ultrasound done without fluid gift it is very difficult to make out any detail.I just think that the local hospital should have been looking for another cause if the urine test came back normal.

I call a doctor for an appointment. I receive an answering machine that promises a call back. I do not receive a call back. I feel that a doctors answering machine is the same as talking to him. I am sick and do not feel iike being lied too. As a result of neglect I died. Can I sue?

Resolved Question: Hospital did not alert me of a abnormality on my Chest CT scan?
Basically, the CT was done to look for any evidence of granulomas in my lungs to confirm or deny an autoimmune disease (sarcoidosis or CSS/WG). They told me everything was normal (this was about 2 years ago). I have been back & forth to multiple doctors, missed work, and continued to live in chronic pain. I picked up a copy of every my CT's on a disk and upon looking at them, my spleen is CLEARLY not right!!! The only way to describe it is "deteriorating". it just looks like it has something nawing away at it... I am not a doctor, but if my spleen has been effected by this disease and for 2 years I have gone with improper treatment because they neglected to inform me (this was a chest CT), is that considered malpractice? I am not a greedy or vendictive person, but this disease diagnosis is based on this info and without a solid confirmation I cannot receive treatment (powerful meds) and it is fatal if not treated properly (look: Bernie Mac; sarcoidosis). I am very mad and very worried, and I have begun seeing doctors at the UCLA medical group better care. I may be jumping the gun, but I would like to know my options if I need to take action. Thanks in advance.

Resolved Question: I need some very important advice my daughter has had tmj for a very long time doctors and dentists have?
done absolutely nothing about it, my daughter is currently hospitalized an every day she complains about her tmj discomfort and pain,but the doctor has said the tmj is not important. My daughter has had this problem for about A year and a half and it makes her depressed. today her face was greatly swollen today it is even medically documented that she has tmj but they just refuse to treat it,is this is medical malpractice what extreme measures can i take to finally receive some relief for my needy abused and neglected daughter she's 21 and they say that her complaints are not important. then they r doing a procedure that makes her situation worse they received permission to do the procedure without her consent they said they would take precaution for her tmj but they have not been taking any special measures. i am afraid they are scarring this young girl for life

Resolved Question: Is it possible to sue the US Military for med malpractice or medical neglect?
I fell durung PT and hurt my right knee (it gave out and I fell to the ground) They took for some xrays, and found out that I had Osteochondritis dissecans. the doc gave me options for surgery, and noted it in my file. They did not give me any surgery to fix the knee. They discharged me saying that the injury was not sevice related or aggravated by service, thus I could not receive the medical treatment that could have helped me. I was Let go in 1985 and tried to seek medical help at the VA and was refused. Before I apply for VA benifits should I talk with a lawyer first???

Resolved Question: Is this medical malpractice?
I have an 11 month old son named Carson. He was born with craniosynostosis and has handled many hardships from his medical condition. To start with he was born by cesarean section after a failed 20 hour long induction of labor. He has already had one previous surgery and will be receiving at least one more. He will also need to receive physical therapy as well as wearing an eye patch to help correct his eye muscle control resulting from the craniosynostosis. If my doctor knew about his birth defect and neglected to tell me would it be considered medical malpractice?

Resolved Question: Can I sue the hospital for malpractice?
I was in a car accident in December of 2008. It was a head on collision with a drunk driver who had no insurance. My mom was driving, I was in the passenger seat and a pal of mine was in the back seat behind me. I was rushed into the ER where I was told (after many x-rays and tests) that my left hand was fractured and I had bruised ribs and lungs, and was VERY lucky. I will agree with that last part. Anyway, they put a temporary cast on my left and and told me to wear it until I spoke to a specialist who would decide if I needed a permanant cast or not. They sent my paperwork to my normal doctor and told me to make an appointment for as soon as possible and sent me home with some papers stating what was wrong with me and how it should be looked after. I finally got an appointment with my doctor three weeks later because when I called to make the appointment, they asked why I was doing it. I told them what was wrong with me from the accident and that I needed a referral to a specialist about my hand. They told me, from the paperwork that the hospital sent to them, that not only was my hand perfectly fine, but I had a fractured sternum as well. I went to my doctor appointment and my doctor showed me the paperwork the hospital sent over. They never told me anything about my sternum and told me my hand was fractured. So I took off the cast and it took me about a month to regain full use of my left hand due to it being immoble for so long. It has now been 7 months on the 13th of July since the accident and I still have pains in my sternum area every few days, leaving me to believe that, since I didn't know I was injured and moved around more then I should have, the fracture healed wrong. So now, my question is this... Since the hospital neglected to tell me what was wrong with me AND misdiagnosed my left hand to start with, can I sue them for malpractice and/or pain and suffering? My mom is looking into sueing the man who hit us, seeing as it was hit 3rd accident while drunk. And she is looking at sueing the insuance company as well because they are suddenly refusing that she had as much coverage as she did and refusing to pay my medical bills.... 10 points to the best answer and lawyers only, please! Or if you have been in this nice of situation before! THANKS!!! But look, my hand WASN'T crushed, there was nothing wrong with it in the first place. No brusing, no fractures, nothing. The x-rays look fine, from what my doctor said. So how is it not the hospitals fault that I was told my hand was fractured when it was my sternum? The paperwork they sent home with me talked about my hand and my bruised ribs and lungs. I was never informed of my sternum being damaged in anyway, neither was my mom or my dad, who came to the hospital about an hour after I arrived. And I should clarify, because my claims and the paperwork the hospital sent to my doctor didnt add up, the nurses refused to make me an appointment right away. My doctor was mad when she found out and I promise that SOMEONE'S butt got chewed for that one. Anyway, that was why the cast was left on for three weeks, it took me that long to receive ahold of a nurse that would make an appointment. -.- I am looking for a new doctor after every this is said and done.

Resolved Question: What is the best way to prepare for a deposition?
I am scheduled to give my testimony for my child's medical neglect/malpractice lawsuit soon. I am very nervous about it! The event has forever changed my son's life and has left him medically fragile. I don't want to do or say anything that will have a negative impact on his case. I feel like his whole future is in my hands with what I say. Of course, I'll talk nothing but the truth, however, I know that the truth can be twisted by nasty opposing attorneys. Can anybody here, with experience in law or personal experience, give me some advice as to how I can prepare for this very stressful event? I have already been thru one, but we need to basically do it every over again because we've brought more doctors into the lawsuit and their attys. need to be gift. That one was hell for me. I had no snooze the night before and was just a wreck. I'm dreading the next one and am hoping someone here can give me some tips on giving the best testimony possible. Of course, my attorney will be gift. I'm looking for real answers here. Please only answer if you have experience and knowledge in the field of law. Thanks. Resolved Question: how do i get some results for the medical malpractice i have recently gone through?
Today i went to the doctor and the last 2 years have been rough since i had my daughter. irregular periods, horribly bad cramping and pain constant what they thought was bladder infections, however today i went to the doctor and he found a metal stitch from when i had my daughter 2 years ago as of june 18th this year. and i feel horribly violated and neglected .has really ruined believing in the health system . How do i go out about getting some results. also does anyone know if i receive my medical file from my doctor from during my pregnancy will my er visits be in there even if i didnt look him?? please help

Resolved Question: Finding a Medical Malpractice Lawyer?
I'm trying to find a lawyer to represent my dad in a medical malpractice case. Spoken to 3 Boston area attorneys who every say he seems to have a case. The problem is the big firm says it only takes multi million dollar cases, the smaller lawyers don't want to put up the money for expert witnesses. My question is IF he seems to have a case of neglect how can he find an attorney that will take the case and file the claim? Can he do it without a lawyer? Is there a way to reach muliple lawyers with one email blast to look if any takers?

Northern Territory Police have charged a man who used fake qualifications to work as a doctor at the Alice Springs Hospital. Singaporean man Balaji Varatharaju, 29, is accused of using a forged university degree to obtain registration with the NT Medical Board. He has been working as an intern (A medical intern is someone who has completed his or her degree, but who does not yet have a full medical license) at the Alice Springs Hospital since May last year, but the Health Department says he did not perform any surgical procedures. Resolved Question: Can I sue a doctor for neglect/medical malpractice if he didn't properly follow my disease?
I was diagnosed with Lupus Nephritis in Sept 07 when I just turned 19. I was told to follow up with the rheumatologist that saw me in the hospital. I did a biopsy and i was found to have stage 3 lupus nephritis so i started seeing a nephrologist. long story short, the rheumatologist didn't receive along with the nephrologist so he told me to cease seeing him and convinced me that he could control my lupus and told me he had many patients with lupus. he slowly started tapering my prednisone and told me i was going into remission. then one month later he lost my blood tests and did not request em back from Labcorp and did not tell me till the next month. within that month i was not on my cellcept and i was on a very low dose of prednisone (10mg) at that point my disease was eating away at my kidneys. that month i went from stage 3 to 4. the next time i saw him he told me that i would have to do chemo. i went to receive a second opinion from my nephrologist. the nephorlogist requested my records from the rheumatologist and when my records were recieved the rheumatologist sent only a tiny part and only the last 6 months of blood tests. my nephrologist then brought to my attention that the rheumatologist the whole time was doing the wrong blood tests and not watching my disease as closely as he should have been. so my question is.. can i sue the rheumatologist for not monitoring my disease and falsely assuring me that he had alot of experience with lupus, when in actuality he did not? i have suffered so much because he slipped up. i had to do 6 months of chemo which caused me to withdraw from school and receive in debt with student loans.. i cant work.. my disease got worse..and the high dose of prednisone caused me to gain over 70 lbs.

Resolved Question: help! medical malpractice with pediatrician? sry so long, pleas help?
My husband is Air Force, so we have Tricare Prime. About a month ago, my son was at a friends home jumping on the trampoline. He came home crying because he said he hit his nose. I took him to his doctor at our local air force base. After looking at him and not even being in the room for 5 minutes, she said that it wasn't broken and gave us antibiotics and nasal spray, saying he had a sinus infection even though he had no mucus or discharge, just horrible swelling, a deformed nose and bruising. The medication didn't do anything at every, so I took him another 3 times this past month trying to tell her that there was something wrong with his nose and it wasn't sinusitis and i thought it was broken. Each time she sluffed us off saying that it'll receive better. The other day I was cuddling with him an looked at his profile. He has my nose, so the bridge of it before was straight and had absolutely no slope. This time it was incredibly sloped, it looked like the cartilage was completely crushed right where the cartilage meets the tip of the nose bone in front. I gently touched it and it was smushy, not difficult like it was before. He wouldnt' let me touch it and sait it hurt. I immediately called patient advocate for a second time (the first time they said they'd handle it but I never heard anything) and then I called tricare. I'm now in the process of getting his doctor changed to a civilian doctor but that takes a while knowing the stupid military insurance. I went on my possess to a civilian doctor and he immediately said his nose was in fact broken, his septum is deviated, the cartilage is broken and his left nostril has changed shape and has no hole airway because the tissue was smashed into the hole. If you look up his left nostril, it's just pink tissue with a tiny crack where the hole used to be. They need to do a CT scan (waiting for them to receive him in) and then I have to go to Denver kids's Hospital (lke an hour and a half away).. I just talked to them and gave them these details. They told me that they usually have a 5-7 day window to do surgery and fix noses before the injury is too old and is healed. They said that since it happened so long ago (a month) that it'll be a more difficult surgery and they might have to break it or it might not even be fixable once they look at it deeper. I'm so mad at this. It's not like I neglect my kid and am a hillbilly or something. I took him to this doctor several times and she completely ignored us and was WRONG. Now my son has to pay, we have to pay. She did the same thing to my younget daughter who had a dermoid cyst on the bridge of her nose/eye bone. She wasn't even a year old and had what looked like a difficult marble below her skin. I took her to the same lady several times and she just said it was "nothing" and to let it be until she was older. I again finally got sleepy and concerned so I took her to a civilian and they said that if I would have left it like the doctor said to do, the dermoid could have grown further into her bone, her sins cavity, her eye and even her brain and could have caused trouble. I never took this further after my daughter's surgery thinking that it was just a mistake or a misdiagnosis and wouldn't happen again. Now that it has happened to my son, I know taht she's a compleye idiot moron and doesn't care about kids or really helping them Sorry this is so long, but does anyone know what I can do? Do I have legal standing wit this for medical malpractice or something? Can I take her to court for this and make sure she can't sluff off other kids with medical issues? What are my rights here? Please help me, I just don't know what to do here. Thanks

Resolved Question: What are your thoughts on the two dilemmas of social poilcy: The compassion vs. control dilemma?
Child abuse has emerged in the last fifteen years as a visible and important social problem. The two dilemmas of social policy alluded to over are defined as: 1. family autonomy vs. 2. coercive intervention (compassion vs. control). and professional response. Theoretical Confusion and cClinical Inadequacy We propose that these consequences result, in part, from medical and legal ambiguity concerning child abuse and from two fundamental, and in some ways irreconcilable, dilemmas about social policy and the human and technical response toward families in crisis. We call these dilemmas family autonomy versus coercive intervention and compassion versus control. How kids's rights-as opposed to parents' rights-may be defined and protected is currently the subject of vigorous, and occasionally rancorous, debate. The family autonomy vs. coercive intervention dilemma defines the conflict central to our ambiguity about whether society should intervene in situations of risk to kids. The traditional autonomy of the family in rearing its offspring was cited by the majority of the U.S. Supreme Court in its ruling against the severely beaten appellants in the controversial "corporal punishment" case (Ingraham vs. Wright et al).25 The schools, serving in loco parentis, are not, in effect, constrained constitutionally from any punishment, however cruel. Yet in California, a physician seeing buttock bruises of the nice legally inflicted by the teacher in the Miami public schools risks malpractice action if he fails to report his observations as symptoms of child abuse (Landeros vs. Flood).32 He and his hospital are potentially liable for the cost of the child's subsequent injury and handicap if they do not initiate protective measures. This dilemma is highlighted by the recently promulgated draft statute of the American Bar Association's Juvenile Justice Standards Project, which, citing the low prevailing quality of protective child welfare services in the U.S., would sharply restrict access to such services.28 The Commission would, for example, make the reporting of child neglect discretionary rather than mandatory, and would narrowly define the bases for court jurisdiction to situations where there is clear hurt to a child. Our interpretation of this standard is that it would make matters worse, not better, for kids and their families.8 So long as we are deeply conflicted about the relation of kids to the state as well as to the family, and whether kids have rights independent of their parents', we shall never be able to articulate with clarity how to enforce them. Resolved Question: medical malpractice against military naval hospital?
Hi, I am considering seeking damages in a lawsuit against the naval hospital on a military base in North Carolina. February 2010 I went into preterm labor with my daughter at 23 weeks gestation. When I arrived at the hospital I was in labor and no efforts were made to cease or prevent my labor. Instead, they went on to induce me, told me my daughter wasn't considered viable until 24 weeks gestation, and I would have to birth and watch as my first daughter died a miserable death. This was a live birth, she lived for over two hours, and I have birth and death certificates. I believe my labor could have been halted, at least to the point of viability. Additionally, I have made several requests via phone and fax to obtain my medical records of the delivery and never received them. These documents were invaluable to my subsequent pregnancy, and I also believe neglect to send the records ultimately led to unforeseen complications in that subsequent pregnancy. I requested an autopsy and never received the results despite several phone calls. I do not believe the autopsy was done, and they fail to send proof of an autopsy. I now reside in Arizona (and believe my permanent residency was still in Arizona even while my husband was stationed in North Carolina. I lived there with him, but kept my license, voter registration, etc in Arizona). The military installation is in North Carolina. I am unsure if subject matter jurisdiction would fall in North Carolina due to it being on a military base, and am unsure of my possess personal jurisdiction in the matter. My questions are, do you think I have a cause of action, and if so, in which court's jurisdiction? Do I have contact a lawyer in that jurisdiction?

Resolved Question: Do I have a medical malpractice case?
I recently had a total thyroidectomy. The surgeon states because my endocrinologist neglected to suggest surgery that should have been done at least a year ago, there seems to be damage to my vagus nerve causing my vocal cords to be paralyzed and breathing has become difficult. Also Stage 1 carcinoma was found and I have to start radiation therapy soon as well as speech therapy. As of now I can't talk or work. Even though I signed a waiver acknowledging the 1% chance that I would either lose my voice or attain permanent hoarseness, do I qualify since the symptoms I now gift are not the result of inury incurred during surgery?

Resolved Question: My son has undiagnosed condition - HELP!!!?
My son was born dead from a lack of oxygen at birth due to medical neglect/malpractice. Anyway he was revived 3 times his first day of life. After years of going to specialists it was finally determined he has brain damage on his frontal lobe - they have no idea why he doesn't have cerebral palsy. He also has a condition where he doesn'tr feel pain ONLY on a skin level. And I think he has seizures every once in a blue moon - he has had like 4 or 5 "episodes" where he becomes almost violent, has a very blank look on his face, says the same things over and over, and then later he doesn't remeber what happened. What do I do? Or anyone have any ideas of what is wrong? He is completely developmentally fine - no problems whatsoever in school or anywhere - he is extremely intelligent as well. A neurologist had said he has no idea what's wrong with him - he has never seen anything like it and says my son is a miracle child.

Resolved Question: I am wondering if anyone has any idea if you can sue a vet for medical malpractice or neglect.?
I posteda few minutes ago about my dog's incision and itching. Nowo I am wondering if you can sue for medical malpractice against a vet. I took my chihuahua to a vet 3 weeks ago and informed him about my dog having troubles urinating adn he told me it was because he licked himself and made his private irritated and infected but didnt give any meds for it just meds for mange. Told me that I would have to wait 3 months for mange treatment to be completed and then he would do shots and then worry about urinatign problem. Well exactly 2 weeks later he almost died on me because he had stones so big that they blocked the tip of his uretha tube and one embedded itself into bone at tip of male part. i had to have emergency surgery performed on dog by another vet because first vet told me he was too busy to look at my dog. I almost lost my dog because of it. My dog also basically had have a sex change surgery at same time because stones tore up uretha tube. First of every he did have mange and vet said he wanted to treat for that. And he felt around for problems in lower area and said every he had was an infection. Stones were big enough were you could look the lump in private with just your naked eye. But vet said that was infection and would go away to put baby oil on his private. Second of every, my mom was in room with me when he looked at my dog. He never offered any nice of tests to find out problem. He wanted to wait for about 4-6 months before he treated the urinating problem. My dog was mistreated when I got him and that was how he got mange. But I don't understand how a vet can feel and look and miss stones in a male private part that are big enough to embedd themselves in the bone at tip of private part.Plus stones were big enough to destroy euretha tube so that the dog had to be made into female so he can urinate. I have a witness to vouche that he didnt offer any tests for the urination problem.

Resolved Question: Wrongful death lawsuit resulting from cancer?
I will try to keep this as short and sweet as possible, but it is a rather long and involved story, so please bare with me. I have a very dear pal, who just lost his 16 year old son to cancer. (the type of which I am unsure of at the moment) The boys mom has not been involved in his life since he was 2 years old. She left him home alone, phoned the dad and told him to go receive his son and has not seen him since. She did pay court ordered child support, but only because she was forced to. When the son died, my pal called her to let her know and her first response was "Good, now I can cease paying child support". Last night, a sheriff served him with papers in a wrongful death lawsuit filed by the mom, saying that his neglect led to his sons death. Needless to say, he was totally shocked and devastated. For the last 3 months, he has pretty much lived in a hospital, sitting by his sons side. He got the best medical care of him, and did everything humanly possible to ensure his son was well cared for. My question is this, how can she sue for anything? She was never a part of the boy’s life; she wanted nothing to do with him. She never paid anything more than what she forced to. How could she even receive a lawyer to take on a case like this? I was below the impression that wrongful death would be related to something like a car accident, medical malpractice or the like. Any info you can offer would be much be very helpful.

i am currently hospetilize in one the memorial hospitals in FL and have a huge medical malpractice , i am here my 11th day with no result the first doctor i had tried to discharge me after 2 days without examine me and without seeing me even for 1 second and by being in the hall way, she also claimed i am to fat to fit the MRI machines ,and need to go somewhere else and mind you i did the MRI right in this hospital after we change a doctor . i would like to sue the hospital and that specific doctor for medical malpractice i feel neglected and a shame , i feel that the doctor was rude and there was many accidents on the way that i cant even discuss over the net i was admitted on the 07/07/09 and after the mess with the doctor they every of a sudden changed the admission date to 07/10/09 , i have paper show that i was admitted on the 07/07/09 if i could only can receive hold of my chart with every the doctors notes you will sure look a huge medical malpractice going on and a big mass and cover ups i came here with severe headache and leg pain that i cant even stand on my legs dizzy , vominiting , and buttom line cant function at every i still cant barley walk and my headache stayed the same for 3 weeks already stabing pains and that not a migraine ...... the first neurologist that checked me was after 10 days i am here, i am getting pumped with 8mg morphine every 3 hours , Valium pills every 12 hours , and more pain killers just to knock me out. they want to discharge me tomorrow with pain killer and that every , they said that did every the testes and every looks good and they cant do nothing. i feel like they didn't do there job right and my main issue was the cover up they trying to do with the main doctor that was on the case that came to my room yelling in front of nurses about me lying and also while i was in pain in my legs she pushed on my legs on purpose to show that i am not in pain and that was in front of nurses my wife and a nurse in charge . mind you that a second befor a nurse tried to check my legs and she couldent even take the socks off my feet coz of the pain i asked her not to be in my room no more and asked to change the doctor and she kept on signing medication and audits for me . it took me overall 6 days to be able to change her out of my case . there is many complains on the same doctor from nurses and paitents. i would like to know if i have a case in this matter . . i feel neglected , i feel hurt , ashamed , i haven't eat at every or drink for More then a week after she said i am to fat for there machines , i am sure that allot of that is because i have no health insurance. or some wierd reason but i am still not healthy. p.s today after i complain about even more pain they increases the morphine dose to 10mg every 3 hours , i am woozy and feel bad i need your help i need justice. i am getting over every like 80mg morph every 24hours i am afraid i will be addicted to that after 11 days in here ..... they want to discharge me with no withrewl from the morph just kick me home. what shel i do the had me in the MRI , MRA , CT , even lumber pucter that the doctor pinch my leg nerv twice and it hurt till now. every test came clean and the final answer is they dont know what wrong and sending me home like this. help any one ? p.s. i am on heavy drugs now and int's 1 am sorry if it's difficult to understand me for susan the nurse : " You are getting a lot of Morphine for your complaints of pains. Seven years ago I confronted my doctor about a medical issue where I was having episodes of dizziness, tunnel vision followed by temporary blindness, and loss of muscle control/tremors and was ignored for many years. Now, about a month ago my mom came to an appt. with me and yelled at her for ignoring this problem. Finally, she is scheduling tests (EKG, echo-cardiogram,etc.) and even suggesting that I don't steer.. If a problem IS found, 7 years after my original complaint and being ignored, do I have grounds for a malpractice suit due to neglect of said episodes? Please, serious and educated responses only. Resolved Question: Is this medical neglect/malpractice?
BACK STORY:: This past week my 3 year old son was very very sick, he had sporadic vomiting of bile, very weak and lethargic, and every 10-15 mins or so we would start screaming in pain saying his stomach hurt. I took him to the doctor that morning and they gave him an IV for dehydration and took some blood work [everything came back normal] and sent us home, saying if he got worse to arrive back. Well he did receive worse later that night and we went back to the ER at 8pm for his severe pain and rag-doll like appearance [he was limp like a rag doll and unresponsive] The ER doctor we seen never did any nice of examination of our son, nor would he hear or address any of my concerns, every he kept talking about was "his diarrhea" and i told him "but he doesn't have diarrhea, he hasn't had a bowel movement since yesterday" and he responded with "don't worry he will....try to keep him hydrated" and sent us home. We then had to return BACK to the hospital on Friday where the doctors FINALLY looked over our son and found that he had intussuseception and was close to death. They were thankfully able to treat him and we are now at home recovering after 4 days in the hospital. My question is...is what this ER doctor did considered medical neglect or malpractice? Or rather the LACK of what he did. Sorry i also want to add that if the doctor did find the intussusception that night it would not have prevented it but it WOULD have prevented him from becomming so sick to the point of close death, and lessoned his recovery time...not to mention the terrible emotional toll this situation of being told nothing was wrong for so many days this has had on my family.

Resolved Question: mrsa staph infection disabled - adult guardianship- legal?
I feel hopeless. but im a young adult in my 20s. im 28 yrs old and i want to have the choice to move away from my parents home but they are controlling. i feel that i need to make a clean break from them, pack up my bags in the night and go to a womens shelter or to hide from my parents,theres safety concerns because theyre so controlling and harmed me in the past. the thing is i had an injury a few years ago and had to leave school to recover, while i was trying to recover to go back to school and receive a job, my dad became terrorizing to me and he made threats to "receive even with me" by going to court. so he went to court and got adult guardianship over me, and then proceeded to terrorise me and boast that he had control over every of my life and that my lifes ruined, every while i could barely walk andwas in severe pain from my injury so because of my physical disability that no one was helping me with, i couldnt receive to court to defend myself and he got gardianship by default even tho i was 24 yrs old. he dosnt do anything for me, never did. but hes abusive and terrorises me and demands attention as soon as i could i tried to receive the guardianship to end, i made dozens of calls to free law agencies and anywhere that i thought could help end the guardianship a few months after i got sick with a deadly disease mrsa and stayed sick for 3 yrs since. so i was too sick to do anything or make calls or go to court, or gather evidence. im still sick. but the reason im sick is because my parents home is colonized with mrsa, where theyure forcing me to stay if i receive up and leave anywhere, to a homeless shelter, a friends home or out of state, since im property of my elderly dad, will the police arrest me? if he dosnt agree with me leaving, even to keep my possess life to receive away from the mrsa infested home? there was no reason for guardianship over me since at the time of the court hearing i wasnt mentally unstable or mentally impaired at every. but he lied in order to receive the guardianship and something unfair went on because everytone involved lied, i have proof they every lied, so im thinking someone was paid or something else fishy. the court psychologist wrote a 4 page "evaluation" of me which was full of lies, he even got my name spelled wrong too. it sounds like things my dad told him that he never checked if it was true or not. malpractice! the judge lied, lawyers lied etc. but my dad has many close friends in the psychiatry business and in courts,since his careers revolved around going to court every the time. and he used to want to be a psychiatrist, police officer, astronaut,game show host, farmer,prime minister of wherever,... you receive the picture (narcissist) he is fascinated by psychiatry, he has some degree in psychology from the 1970s but never worked in that feild, but so does my aunt and she almost starved her son to death and used to beat him often. so any creep can receive a psychology degree the reason he told the judge that he needs guardianship is because he told them im autistic which im not but the judge still wrote that im mentally incapacitated. also the court psychologist or another psychologist who my dad hired to go against me that i wasnt a patient of said that im a danger to society and severely schitzophrenic and so on,, terrible bad things that are not true im obviousely not schitzophrenic, mentally sick or autistic but im physically sick right now so i cant prove"functioning" since my doctors know i cannot work because im sick with a disabling medical problem. but i dont think that means my dad should keep guardianship over me since he dosnt even talk to me and dosnt know much about me.he didnt lift me, i had to lift his youngest child a few yrs ago when she was a teenager.since my parents neglected my younger sister. i believe my parents are keeping me sick to keep me disabled so that i cant be well enough to stand against them and talk the truth and work on my career so what do i do since im too physically sick to go to court? how do i receive rid of the guardianship if im not physically well enough to go to court and im too physically disabled to work? i cant impress any judge since i have a deadly longterm medical problem, and someone having guardianship over me is making it worse, because im being restricted from helping myself and no one is helping me anyways and im obviousely competent enough to lift his younger daughter that he neglected and take care of my nephew. so my dad thinks its a big joke to have guardianship of me and control me. hes a psychopath so he will never let me make a good decision to help my life, he also tries to isolate me from friends, he calls me stupid and tells me he will never allow me to work. he is a terror i dont want to be treated like a mentally disturbed person since theres nothing wrong mentally with me. so its not safe to have someone have control of me also im in the usa and ive tried calling legal aid, free lawyer agencies and the legal aid agency thats the only one in my area "knows me" and talks bad things about me amoing the manager and every lawyers there because my dad keeps going to court against me for no reason. hes gone maybe 15 or so times for stupid reasons not necessary to receive attention from the court and the law agency blames me and theyre anoyed by me that i cant control any of my parents my dad spoke to every of the legal aid lawyers and he told them im autistic so they told me they wont help me because they were told im autistic so they said they want guardianship(but im not autistic), they are giving me problems and never wanted to help me even tho i couldnt receive to court. they were rude to me and wouldnt help me receive a representative to go to court intsead of me. they also commited malpractice by saying slander against me to people in public who arents supposed to know about the court cases so thats out of the q

i believe i have asthma. yeah i saw a lung doctor 3 times in 10 months time he never said i had asthma, even though i knew i did, gave me meds without seeing me passed me off as not having asthma and within 30 minutes of seeing my new regular doctor and her reading what i gave her she said i had at least exercise induced asthma. my lung doctor said i had reflux even though my symptoms pointed to asthma. my normal peak flow is between 360-400 and one time i saw him my peak flow was only 270 and he let me walk out of his office like that. and at my second appointment i gave the lugn doctor my asthma journal he took it for a few seconds then gave it back to me nevfer opened or read it(which pissed me off). and i just now thought of this: i called the doctor once and asked for an inhaler and he gave me on over the phone, and i just thought of this he gave me that inhaler when he told me that it was not asthma, which is wrong. it was like u give me a rescue inhaler which is used to treat asthma which u say i do not have. i looked up how to sue a doctor and it said u have to have had hurt done because of there neglect, but not sure about that. could i say that the hurt is that he gave me meds for a disease he said i did not have? i need help i want justice.

Resolved Question: medical negligence/malpractice law case?
About a year ago my sister had that surgery for hyperdydrosis where they clip into you chest and snip something to make you not sweat. She used to sweat from the neck and over. Now, she claims that she sweats from the neck down. She is every pissed off saying the dr. who did the surgery neglected to tell her that she could sweat somewhere else. I told her I'm sure somewhere in her medical records or consent forms it should have stated what the possible side effects might be. Since she claims the dr. didn't tell her, she wants to sue for medical negligence. Suppose the dr. really didn't tell her about sweating other places, does she have a case? I told her I don't think any lawyer will take her case. Am I right? That's what I thought. She said she wasn't going to sue to monetary value, but it was the principle. I told her a lawyer is in business to make money and I don't think she'll find one that will work on a contingency basis especially when the surgery did what it was supposed to do. Thanks Rebecca. I think you hit the nail on the head! Dr's nowadays cover their ass. I'm sure he went over the side effects. From what I've read about the surgery itself, compensation sweating is very common.
